Women’s Living the Dream Ride Sweepstakes (the “Sweepstakes”)
1. General Information
2. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE YOUR ODDS OF WINNING. ODDS OF WINNING DEPEND UPON NUMBER OF ENTRIES. SWEEPSTAKES VOID WHERE PROHIBITED BY LAW.
3. Eligibility: Participation in the Sweepstakes is open only to legal residents of the United States who have reached the age of majority by the first day of the sweepstakes dates as described in Section 1 above. Employees, officers & directors of Sweepstakes Sponsor, its franchises or licensees, their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies and the immediate families or members of the same household of such employees/officers/directors are not eligible to enter. Sweepstakes is void in Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, and where prohibited by law.
4. Sweepstakes Dates: The Sweepstakes Dates begin at the Sweepstakes Start Date as described in Section 1 above and ends at the Sweepstakes End Date as described in Section 1 above.
5. Prize: Prize winner will be drawn randomly from the pool of eligible entries nine (9) days after the Sweepstakes End Date as described in Section 1 above. The Prize winner(s) will receive the Sweepstakes Prize as described in Section 1 above.
Total retail value of the prize(s) is as described in Section 1 above. No prize substitution is allowed by winner. No cash equivalent for the prizes. Sponsor reserves the right to substitute any listed prize for one of equal or greater value for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use. The prize will be subject to the Sponsor’s policies. The prize is provided "AS IS" and without any warranty of any kind. Limit one prize per household/family.
6. There are three (3) ways to enter: (1) Log onto Sponsor’s Website, as described in Section 1 above (“Website”), and register to ride in the Women’s Living the Dream Ride event by pressing the submit button and completing payment for registration during the Sweepstakes Dates. You will receive one (1) entry into the Sweepstakes upon successful payment, completion and submission of the registration form. (2) Log onto Sponsor’s Facebook Page, as described in Section 1 above (“Facebook”), and click to “Like” the page then fill out the Sweepstakes Entry form. You will receive one (1) entry into the Promotion upon successful completion and submission of the online entry form. (3) Legibly print your first and last names and valid email address on a post card and mail the card to Living the Dream Foundation, Womens’ Living the Dream Ride Sweepstakes, at the Sponsor Mailing Address described in Section 1 above. All U.S. mail entries must be postmarked by within the Sweepstakes Dates and received not later than 8 days from the end of the Sweepstakes Dates.
Participants can enter the sweepstakes via 2 different ways listed above for a total of two entries per person, per email address. In case of dispute as to identity of participant, entry will be declared made by the authorized account holder of the email address submitted with the entry. “Authorized Account Holder” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning email addresses or the domain associated with the submitted email address. Any other attempted form of entry is prohibited; no automatic, programmed; robotic or similar means of entry are permitted.
All entries become the sole property of the Sponsor and receipt of entries will not be acknowledged. Delivery of prize requires a first and last name and valid email address. Sponsor is not responsible for telecommunications, network, electronic, technical or computer failure or any kind of lost, late, incomplete, mutilated, invalid, unintelligible, misdirected entries, all of which will be disqualified. Facsimiles, mechanical reproductions, alterations or forged entries will not be accepted. Only completed entry forms with valid email addresses are eligible and all ineligible entries will be disqualified.
7. Drawing: Winner will be selected in a random drawing from all eligible entries received. The drawing will be conducted by Sponsor shortly following the Sweepstakes Dates. After selecting a winner, Sponsor will select two back up winners and place the entry forms in a sealed envelope. In the event that the first entry form selected is discovered to be invalid for any reason whatsoever, or if the person who submitted the first entry form does not respond to the notification that they won as described in section 8 below, Sponsor will randomly select a winner from the back up winner names, who shall be subject to the same rules and conditions set forth herein. All decisions of Sponsor are final and binding.
8. Notification: Winner(s) will be notified by email within 2 days of each drawing. If unable to make contact with the winner within three (3) days after Sponsor first attempts to notify the winner, or if the winner fails to claim the prize, Sponsor will select a back up winner in accordance with the above. Likewise, if the original winner is ineligible or in the event of non-compliance with any other requirements of this Sweepstakes, the winner shall forfeit the prize in its entirety, and Sponsor shall award the prize to an alternate winner selected in accordance with the above.
9. Conditions: All taxes and other expenses associated with the receipt or use of the prize are the sole responsibility of the winner. Participation in the Sweepstakes constitutes participant’s permission for the Sponsor to use his/her name, hometown city and state, likeness, biographical information and any statements made by participant regarding the Sweepstakes or Sponsor for editorial, advertising, public relations, and promotional purposes without notice or additional compensation, except where prohibited by law.
By entering the Sweepstakes, each participant warrants that he or she has read and agrees to abide by all of these Official Rules and that he or she is not prohibited from participating in the Sweepstakes. Each participant agrees to release, discharge, indemnify and hold harmless Sponsor and its parent, subsidiaries, affiliates, shareholders, employees, officers, directors, agents, representatives, advertising and promotion agencies and prize suppliers from any liability arising from or related to the sweepstakes, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. BECAUSE SPONSOR COLLECTS PERSONAL INFORMATION FROM PARTICIPANTS ENTERING THIS SWEEPSTAKES, SPONSOR ENCOURAGES ALL PARTICIPANTS TO REVIEW ITS PRIVACY POLICY.
10. Additional Terms: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend this Sweepstakes for any reason. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or Sponsor’s website. Sponsor reserves the right to prosecute any fraudulent activities to the full extent of the law.
11. Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, other than those concerning the administration of the Sweepstakes or the determination of winners, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved exclusively by the Washington State Court, for the city of Snohomish; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Washington, without giving effect to any choice of law or conflict of law rules (whether of the State of Washington or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Washington.
12. Winners List or a copy of the Official Rules: To obtain name of prizewinner or a copy of the Official Rules, send a self-addressed, stamped envelope by the Sweepstakes End Date as described in Section 1 above to the “Sponsor Mailing Address” as described in Section 1 above, attention: “Women’s Living the Dream Ride Sweepstakes Winner List Request”
